1. Agreement to These Terms

These Terms of Service (the "Terms") govern your access to and use of Recruitee, including any websites, apps, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.

2. Definitions

  • "Customer" means the person or entity that registers for an account.
  • "User" means any individual authorized by a Customer to access the Service.
  • "Content" means any text, files, images, candidate data, job data, messages, prompts, or other materials submitted to or generated via the Service.
  • "Third-Party Services" means services, products, or platforms not provided by Recruitee that may integrate with the Service.

3. The Service

Recruitee provides recruiting workflows that may include candidate search, outreach, pipeline management, collaboration, analytics, and automation features. The Service may rely on machine learning and other automated systems.

We may modify, suspend, or discontinue any portion of the Service at any time. We will use commercially reasonable efforts to provide advance notice for material changes where practicable.

4. Eligibility

You must be at least the age of majority in your jurisdiction to use the Service. By using the Service, you represent that you meet this requirement and that your use is not prohibited by applicable laws.

5. Accounts, Security, and Admin Controls

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to promptly notify us of any unauthorized access or suspected security incident.

Customers may designate administrators who can manage Users, permissions, and settings. You are responsible for ensuring that your administrators maintain appropriate access controls.

6. Acceptable Use

You agree not to misuse the Service. For example, you will not:

  • Violate any applicable law, regulation, or third-party rights
  • Send spam, harassment, or unlawful communications
  • Upload or transmit malware or attempt to disrupt the Service
  • Access or scrape data from the Service except as permitted by the Service and applicable law
  • Attempt to bypass security, access controls, rate limits, or usage restrictions
  • Use the Service to build or benchmark a competing product without our prior written consent

You are responsible for ensuring that your recruiting practices, outreach, and candidate data handling comply with applicable employment, anti-discrimination, privacy, and communications laws.

7. Content and Data

You retain ownership of Content you submit to the Service. You grant Recruitee a worldwide, non-exclusive license to host, store, transmit, display, and process your Content solely to provide, maintain, and improve the Service, and as otherwise permitted by these Terms.

You represent that you have all rights and permissions necessary to provide Content to the Service, including where Content contains personal data of candidates or other individuals.

8. AI Features and Outputs

Some features may generate recommendations, summaries, rankings, messages, or other outputs based on your inputs ("Outputs"). Outputs may be inaccurate, incomplete, or inappropriate for your particular use case.

You are responsible for evaluating Outputs before using them, including ensuring that hiring or employment decisions comply with applicable laws and your internal policies.

9. Third-Party Services

The Service may support integrations with Third-Party Services (for example, email providers, calendars, applicant tracking systems, or messaging platforms). Your use of Third-Party Services is governed by their terms and policies, and we are not responsible for Third-Party Services.

10. Fees, Billing, and Taxes

If you subscribe to a paid plan, you agree to pay the fees described at the time of purchase. Fees are billed in advance on a recurring basis (monthly or annually) unless otherwise stated.

You authorize us (and our payment processor) to charge your payment method for recurring fees and any applicable taxes. You are responsible for all taxes, duties, and governmental assessments associated with your purchase, except taxes based on our net income.

11. Renewals, Cancellations, and Refunds

Subscriptions automatically renew unless you cancel before the renewal date. You can cancel at any time through your account settings. Cancellation takes effect at the end of your current billing period.

Fees are non-refundable except where required by law or expressly stated in writing by Recruitee.

12. Intellectual Property

Recruitee and its licensors retain all right, title, and interest in and to the Service, including all software, designs, trademarks, and other intellectual property.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that you have reviewed our Privacy Policy.

14. Confidentiality

You may receive non-public information about the Service. You agree to keep such information confidential and to use it only as necessary to use the Service. This obligation does not apply to information that becomes public through no fault of yours.

15. Suspension and Termination

We may suspend or terminate your access to the Service if we reasonably believe:

  • You have violated these Terms
  • Your use poses a security, legal, or operational risk to us or others
  • We are required to do so to comply with law or a valid legal process

Upon termination, your right to use the Service ceases. Certain provisions that by their nature should survive will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.

16. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

17. Limitation of Liability

To the maximum extent permitted by law, Recruitee will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or business opportunities.

To the maximum extent permitted by law, Recruitee's total liability for any claim arising out of or related to the Service will not exceed the amounts you paid to Recruitee for the Service in the three (3) months preceding the event giving rise to the claim.

18. Indemnification

You agree to indemnify and hold harmless Recruitee and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or your violation of these Terms.

19. Governing Law

These Terms are governed by the laws of the jurisdiction where Recruitee is established, without regard to conflict of laws principles. If you are a consumer, you may have additional rights under the laws of your jurisdiction.

20. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date indicates when these Terms were last revised. If we make material changes, we may provide notice through the Service or by other means. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.
